Reorganization of the legal position of ARUMIL

ORANJESTAD – The Ministry of Justice and Social Affairs recently announced that they are working on reorganizing the legal position of ARUMIL with the aim of further professionalization.

The goal is to develop a new legislative concept and to stop using the conscription ordinance as a basis, as it is an old law. This national ordinance and decree will regulate the legal position of ARUMIL personnel.

For this purpose, the expertise of, among others, the Department of Personnel Affairs and the Department of Legislation and Legal Affairs (DWJZ) is needed, as well as some departments in Curaçao and the Netherlands.
Meanwhile, the Minister of Justice and Social Affairs, Rocco Tjon, has met with Marnix Alink, Director of Legal Affairs at the Ministry of Defense of the Netherlands, and Commander of the Navy Walter Hansen, who is the highest authority of the Coast Guard, ARUMIL, and CURMIL.

In 2022 and 2023, the government developed several concepts and defined ARUMIL's vision and strategic direction.  

It established a timeline that by November 2024, the final version of the legislative concepts will be ready for analysis and advice by DWJZ. The intention is to start the legislative process at the beginning of 2025 and implement it by January 1, 2026.

The entire process will change the legal position of ARUMIL personnel, appointing them as civil servants and allowing them to continue in the judicial chain after their trajectory with ARUMIL. In anticipation of the law approval in 2026, they will analyze how many ARUMIL members will leave the service at the beginning of 2026 to prepare them for entry into, for example, the police, KIA, CEA, etc. Meanwhile, the police are investigating specific functions in their organization to place ARUMIL personnel who must leave the service.

For this transition to be successful, ARUMIL personnel must receive the relevant preparation to continue within the judicial chain, for which the Netherlands has shown a willingness to help with funding to achieve this.
