Dutch Supreme Court opens the possibility for same-sex marriage in Aruba
ORANJESTAD - On December 6, 2022, the Common Court of Justice of Aruba delivered a verdict that same-sex couples must be allowed to marry in Aruba. Additionally, the Court ruled that no changes to the law are necessary to make this possible.
The Aruban government consulted a cassation lawyer and contested the claim that no law amendments were necessary.
On July 12, 2024, the Supreme Court ruled that excluding same-sex couples from marriage constitutes discrimination that conflicts with our Constitution and confirmed the verdict of the Common Court of Justice of December 6, 2022.
With the Supreme Court's ruling, marriage for same-sex couples becomes possible in Aruba in the same manner as marriage for opposite-sex couples.
The Government of Aruba will comply with the Supreme Court's ruling.
